The lesson from Massachusetts is that voters are angry and it's time for Democrats to stand up to corporate interests and fight for working families by passing health care reform and taking on Wall Street.<br />

And make no mistake: Democrats still have the ability to pass health care reform and other progressive legislation. They have a larger majority in Congress than Republicans ever did under George W. Bush—and even in Massachusetts, polls show that voters continue to support a bold, populist agenda.4<br />
<br />
But it took an unprecedented grassroots movement to elect this President and Congress—and it'll take all of us standing together now to get their attention, and get them to show some backbone.<br />

OLBERMANN: In anticipation of today`s ruling, one Democratic in Congress, Alan Grayson of Florida, having introduced five bills last week, in an effort to prevent the expected flood of corporate cash. By title, they are: the Business Should Mind Its Own Business Act, the Public Company Responsibility Act, the End Political Kickbacks Act, the Corporate Propaganda Sunshine Act, and last but certainly not least, the Ending Corporate Collusion Act.<br />

GRAYSON: Thank you.<br />
<br />
OLBERMANN: You were in the courtroom when the Supreme Court announced this decision. What`s your reaction to the decision? What has the reaction been to your five bills?<br />
<br />
GRAYSON: I`m shocked. I`m shocked by the decision. This is the most irresponsible decision by the Supreme Court since the Dred Scott decision.<br />
<br />
OLBERMANN: Agreed.<br />
<br />
GRAYSON: . over 100 years ago. The one that you referred to, the Dred Scott decision has some analogy to it. In the Dred Scott decision, the court decided that slaves and their free born children do not have any constitutional rights.<br />
<br />
Today, the court, in effect, decided only corporations have constitutional rights. This will lead to a drowning flood of money from corporations in exchange for favors. And it basically institutionalizes and legalizes bribery on the largest scale imaginable. Corporations will now be able to reward the politicians that play ball with them and will be able -- they will be able to beat to death the politicians that don`t.<br />

OLBERMANN: And the entire issue of money has just changed, has it not? I mean, a corporation and I`ll take the one that we`re on right now, G.E., because it`s the one we`re on right now. And it`d be disingenuous to leave them out this of equation, but G.E. or any other corporation of relative size could buy its own Senate, couldn`t it?<br />
<br />
GRAYSON: Well, I think you won`t even hear people talk anymore about the senator from Kansas or the senator from Oregon. Instead, it`ll be the senator from G.E. and the senator from Microsoft. Maybe we`ll end up wearing corporate logos.<br />
<br />
But I think we can fight back. I did introduce those bills. We`re circulating a petition on SaveDemocracy.net. We already got 20,000 people who signed the petition and we`re going to show people power. We`re going to show that you can fight back against a decision like this in very practical ways.<br />
<br />
For instance, one of the bills that I introduced says that if a corporation is going to try to buy an election, at least they have to get the prior authorization from their shareholders. I think that`s a practical thing to expect. We`re also -- I`ve also introduced another bill that says that if you`re going to spend money like that, you have to disclose that to the public immediately. And the Supreme Court itself said in its decision today that that`s constitutional -- the requirement of immediate disclosure.<br />
<br />
OLBERMANN: But given the passivity of voters and nonvoters, particularly in this country, is that not the real nightmare in this, that if you pass these acts, even if you pass these acts before the midterms later this year, that the corporations can roll out the bank wads and buy your successors and roll everything back by this time next year?<br />
<br />
GRAYSON: But it`s even worse if we do nothing. If we do nothing and allow what amounts to the facilitation of a corporate coup to rule America, you can kiss this country goodbye.<br />

OLBERMANN: Yes.<br />

Justice Stevens wrote in the dissent, Congressman, "The framers took it as a given that corporations could be comprehensively regulated in the service of the public welfare." Why is it that judges are only called activists when they rule against what conservatives want?<br />
<br />
GRAYSON: I wish I knew, but the same five judges today who have overturned 103 years of settled law and relied upon no precedent to do so, these are the same judges who gave us George Bush for eight years. They have their own agenda and it`s time we stopped pretending otherwise. The Supreme Court has become utterly politicized and the result of that is what you see here today.<br />
<br />
OLBERMANN: Justice Stevens also wrote in the dissents, "Although they make enormous contributions to our society, corporations are not actually members of it. They cannot vote or run for office, because they may be managed and controlled by nonresidents. Their interests may conflict in fundamental respect with the interests of eligible voters."<br />
<br />
Does the decision really make corporations not kind of persons but actually super-persons?<br />
<br />
GRAYSON: Absolutely. Why should they bother to run for office or vote when they can buy and sell elected officials by the gross?<br />
<br />
OLBERMANN: And what do you do -- if somebody is watching this who would understand the horrors and the breadth of this thing, what do they do?<br />
<br />
GRAYSON: Well, for starters, sign our petition at SaveDemocracy.net and then monitor that site for more things to do. These six bills have to pass. And what we need to do is to get people involved. Call their congressmen, write to their congressmen. Make sure that this package to save our democracy actually gets enacted into law.<br />

And it struck down a law saying corporations couldn't buy "issue ads" -- which only thinly veil support for or opposition to specific candidates -- in the closing days of campaigns.<br />

Picking up where the network left off in 2009, Fox News jumped into its first political campaign of the year, this time setting its sights on the U.S. Senate to help elect Republican Scott Brown to the seat previously held by Democrat Ted Kennedy. Fox News and other media conservatives anticipated and celebrated Brown's election with a hyperbolic fervor that would redden the faces of the "Obamaniacs" they most despised in 2008. As conservative media saw it, in defeating Democratic challenger Martha Coakley in Massachusetts, Scott Brown took down Goliath, the 1980 Soviet Olympic hockey team, the Berlin Wall, and the British Empire. Before Brown assumed his seat in the Senate, he had been nominated by Drudge and Fox News to be our next president.<br />
<br />
Fox News didn't simply cheer from the sidelines of this contest. Indeed, the network actively aided Brown's campaign. Fox News repeatedly hosted Brown in the days leading up to the election, and during each appearance, Brown directed viewers to his website to find out "how to help with donating and volunteering." Fox News political analyst Dick Morris took it upon himself to urge viewers to "go to DickMorris.com ... to help elect Brown," because if "we win this fight, then there will never be another victory for Obama." When asked at a rally about "ethical questions" raised by Fox News' advocacy for Brown, chief political correspondent Carl Cameron fled, saying he didn't have time to answer. But he did have the time to autograph "Brown for Senate" campaign materials and pose for pictures with Brown's volunteers, as Think Progress documented.<br />
<br />
Fox News also did Brown the favor of repeatedly misrepresenting remarks Coakley made to portray her as incompetent. America's News HQ anchor Gregg Jarrett stated on January 17, "Martha Coakley is out of step when she says things like terrorists are no longer in Afghanistan, or in the debate saying, quote, 'We need to get taxes up.' " Interpreting Coakley's remarks in this way requires a willing suspension of basic verbal reasoning skills; and that was Fox's "straight news" programming. On Fox & Friends, Steve Doocy actually claimed that Coakley "suggested the Taliban [are] gone from Afghanistan," and Michael Scheuer declared that Coakley "doesn't seem to mind" that "we are losing there." For his part, Glenn Beck accused Coakley of "religious bigotry" for saying that those who would "deny emergency contraception to a woman who came in who had been raped" probably "shouldn't work in the emergency room."<br />
<br />
In case boosting Brown while attacking Coakley wasn't a sufficient strategy, Fox News baselessly fomented fears that Democrats would "cheat" to steal the election. Warning Fox News viewers not to become complacent before Election Day, Beck stated, "[Y]ou can imagine how ugly this thing will get if -- oh God help us all -- if it's too close to call." Beck displayed the ACORN logo and added, "[T]hey have friends in low places." Invoking the Florida recount, Beck asserted that Democrats "were so incompetent they didn't even know how to cheat. But don't worry -- they've gotten good at it now."<br />
<br />
Fox even told viewers that they could strengthen their 401(k)s by electing Brown. Echoing CNBC's Jim Cramer, Fox Nation declared that "Brown Win Could Cause Huge Stock Rally." On Election Day, Fox & Friends co-host Gretchen Carlson introduced Fox business contributor Stuart Varney by stating, "Well, you may want to make a call to Massachusetts and get some people out to the polls. Well, that's because our next guest, and a friend, says that your portfolio could look much better if Scott Brown wins Ted Kennedy's vacant Senate seat." As Varney spoke, Fox & Friends displayed an on-screen text reading: "What can Brown do for you? A boost in your 401K may be in the cards." And over on Fox Business, Charles Payne asserted that a Brown win "fertilizes the soil for an incredible longer-term stock market rally."<br />
<br />
But after closing up 115 points on January 19 before election results were in, the Dow Jones Industrial Average fell 122 points the day after Brown's victory and another 213 points the next day. Baffled by this turn of events, Beck said on his radio show, "I'm not sure why it's coming down" since "it made total sense to me" that the market would "go through the roof" if Brown won.<br />
<br />
Predictably, conservative media saw no limit on what Brown's victory could signify and to what extent progressives and progressive policies could suffer. Media outlets converged on a few shallow narratives: The election was a referendum on Obama; Obama should move to the right; and voters have rejected health care reform. (Somehow, Americans hadn't reached these conclusions by January 10, when Coakley still held a comfortable lead.)<br />
<br />
Exit polls, however, showed that a majority of Massachusetts voters approve of Obama's job performance. And contrary to the claim that Brown's victory means Congress should toss out health care reform, Massachusetts is not representative of the nation as a whole. Indeed, the state already passed a health care program that insures nearly all residents -- a unique situation that allowed Brown to argue that his state would not benefit from national reform. Brown, and the vast majority of Massachusetts, supported the state's 2006 reforms, which are widely seen as the model for the national plans currently under consideration in Congress.<br />
<br />
In fact, Brown himself has rejected claims that the election was a "referendum" on Obama or on health care reform. When it comes to passing major legislation — reforming health care, reining in Wall Street, curbing climate change — the Obama administration is under fire from all sides for bowing to special interests and conducting government business behind closed doors. But there's one agency where the hope and hype of the campaign trail have transitioned seamlessly into effective governance: the Environmental Protection Agency.<br />

With a minimum of fanfare, new EPA administrator Lisa Jackson has established herself as the agency's most progressive chief ever — and one of the most powerful members of Obama's Cabinet. In her first year on the job, Jackson has not only turned the page on the industry-friendly and often illegal policies of the Bush era, but has embarked on an aggressive campaign to clean up the nation's air and drinking water. Under her leadership, the EPA has sought stricter limits on toxic pollutants like mercury, moved to scrub emissions of arsenic and heavy metals from coal-fired plants, and revoked a permit for the nation's largest mountaintop-removal coal mine. "The American people can be outraged when we're not living up to the P part of our name," Jackson says. "The protection part."<br />
<br />
Even more striking, Jackson has expanded the EPA's mandate to include sweeping new powers to crack down on climate-warming pollution from cars and industry. The move, which has the full backing of the White House, could prove to be the only viable way to stop Big Oil and Big Coal from overheating the planet — especially after the disastrous collapse of climate talks in Copenhagen in December. "If Congress doesn't pass legislation on climate change," says Carol Browner, Obama's climate czar, "EPA will follow through under the requirements of the Clean Air Act."<br />

Taken together, Jackson's efforts represent a sweeping attempt to revitalize an agency that was gutted during the Bush years. The goal, as she sees it, is to once again base environmental regulations on science and the law — not on the demands of well-connected industries. "Under Jackson, it's a whole new ballgame," says Eric Schaeffer, who resigned as the agency's director of environmental enforcement in protest over Bush policies. "You now have an EPA administrator who has White House support but is still tough enough to provide an independent voice for the environment."<br />

Yesterday, from within the dark isolation of the Supreme Court, these five men pulled off a black-robed coup against the American people's democratic authority. In an unprecedented perversion of judicial power, this court cabal has decreed that corporations have a free-speech "right" to dip into their corporate coffers and spend unlimited sums of money to elect or defeat candidates of their choosing.<br />
<br />
Corporate interests already had too much money power over our political system. No other group in America comes anywhere near the spending clout that this relatively small clutch of wealthy special interests wields over our elections and government. So it's ludicrous for anyone – much less Supreme Court judges – to argue that the corporate voice is a victim of political "censorship." This is not merely judicial activism, it is judicial radicalism.<br />
<br />
Thomas Jefferson warned about the dangerous rise of corporate power, declaring that must "crush in its birth the aristocracy of our moneyed corporations." Today, I'm sure that founding patriots like Jefferson are not simply spinning in their graves at the Supreme Court's surrender to this aristocracy – they're trying to claw their way out of their graves to throttle all five of the traitors.<br />
